WOMAN'S MODESTY!


AHEM.. perhaps one of the topics people wud be interested in knowing and talking about.
The honorable Supreme court of India, on 21st March 2007, declared what is said to be the most debatable and infact a statement of what people from ages have been not able to answer and ofcourse what men have been upto.. outraging the woman's essence.
So what exactly is this essence of a woman? What exactly is modesty of woman?

"The essence of woman's modesty is her Sex" - so says the SC

Good..this was the result of the labour of the bench comprising of Justices Arijit Pasayat and S H Kapadia who will be filling a glaring void in the Indian Penal Court, 1860, but the scope of the definition of "modesty" as mentioned in Section 354 appears to go far beyond what the framers of the code possibly had in mind. Framers never would have thought this would come their way!

"The act of pulling a woman, removing her clothes, coupled with a request for sexual intercourse..would be an outrage to the modesty of a woman; and knowledge, that modesty of a woman; and knowledge, that modesty is likely to be outraged, is sufficient to constitute the offense," the bench said in a judgment that has drawn several verdicts by different courts.

In other words, outraging a woman's modesty as mentioned in Section 354 will apply to crimes against women that stop short of penetration, in which event it becomes a rape. In the same judgment, the court ruled that penetration alone was sufficient to qualify as a rape whether there has been ejaculation or not.

Anywayz, things are quite clear now. No wayz can anyone( preferably MEN) can effect a woman's modesty, for god's sake..its her sex man. Any kind of sexual assault, u r definitely effecting her modesty, and please do not imagine any further than that.. u'll be hanged!
Definitely there was a major section of woman society which went against this decision of SC stating that they wanted no one to define what their modesty is. It is already ingrained in their minds. Yes, perhaps a bench with two women wouldn't have thought in the same way!

But the question remains...Would this defining act sufficient to nab and book those who eve-tease, harass and victimize women -- strangers and acquaintances, even family members?
Lets see.. by the way.. SC India comes up with the definition, abide to it. India's Shining people!
